City of Thunder Bay: Fence By-law

The City of Thunder Bay does not require a permit for the erection of a fence, unless the fence is surrounding a swimming pool. By-laws are in place to specify standards for fencing, and construction, including maximum heights. 

THUNDERBAY – SWIMMING POOL FENCE BY-LAWS

These by-laws apply to privately owned swimming pools, that are either 

  • Operated with a filtration system and
  • Contain at least 24 inches of water

Iron Fences Make Great Pool Enclosures – Have a Peek!

 

Permits are mandatory before excavation or pool erections can occur. Water Placement is also prohibited until fences and gates have been put in place. In the case of above ground pools, steps must be fenced and equipped with gates.

Also be sure that

  1. Fence Height: is greater than 48 inches above grade
  2. Prevent Climbing Hazards: there should …not be any “openings, rails or horizontal/ diagonal attachments on the outside [of fence] that would facilitate climbing
